Subject of the contract

Bonjour Verbier sells you the goods ordered exclusively under the following general terms and conditions (GTC). This is subject to special agreements, especially when purchasing defined products in our online shop.

Conclusion of contract

You can order from our Bonjour Verbier online shop, by phone, by e-mail or by post. The contract between you and Bonjour Verbier is concluded on the basis of your order. You will be informed of the acceptance of your order by e-mail. When you order from the online shop, you will receive an automatic order confirmation. This merely confirms the completion of the electronic ordering process. The contract is not concluded until Bonjour Verbier has expressly accepted your order. Bonjour Verbier may also refuse an order without giving reasons.

Delivery time

Bonjour Verbier usually ships items in stock no later than the next working day. For items that are no longer in stock at Bonjour Verbier, they are organised and ordered from our suppliers.

Terms of delivery

The articles you have selected will be sent by Swiss Post sent by A Mail. Shipping time: approx. 4 to 5 working days, up to 10 working days. The shipping costs will be calculated at the end in the shopping cart.

Bonjour Verbier, with reference to Art.185 para.2 of the Swiss Code of Obligations, states that the benefit and risk of the goods ordered are transferred to the buyer after Bonjour Verbier has posted the package at the post office. If any damage occurs during transport to you, you must contact the post office immediately upon receipt of the parcel and report the damage to the post office.

The products offered in this shop, if in stock, will be delivered within seven working days. For orders of furniture and garden furniture, we will inform you individually about the expected delivery time when the order is accepted. For custom-made products the conditions in our order confirmations apply.

 

Terms of payment 

All prices are in Swiss Francs (CHF) including the legal value added tax. Payment is only possible with the means of payment accepted in the online shop or by advance payment to our bank. If the products sent by us are not accepted or collected by the customer and are returned to us, the customer will be charged for all transport costs.

Retention of title

The goods delivered remain the property of Bonjour Verbier until the purchase price has been paid in full. Bonjour Verbier is entitled to register a corresponding retention of title. If a customer defaults on payment, Bonjour Verbier has the right to withdraw from the purchase contract.

Right of return

You must check the goods ordered for defects and completeness immediately upon receipt and notify Bonjour Verbier of any defects in writing or by email within five days of receipt of the goods. Any complaints made after this time cannot be considered. Bonjour Verbier will contact you as soon as possible after receipt of the notification of defects in order to find a solution for you. Bonjour Verbier is entitled to exchange the defective goods for goods that are free of defects or for a shopping voucher equal to the purchase price of the defective goods. Returns without our written consent will not be accepted. The return of ordered and defect-free goods is excluded in principle. Only unused and originally packaged products ordered in the online shop have a right of return. In this case, the ordered product must be returned to Bonjour Verbier within 5 days of delivery to the customer. The customer bears the full cost of the return shipment. In this case, the return must be made to Bonjour Verbier, 16, rue de la poste, 1936 Verbier, Switzerland.

Privacy policy declaration

Bonjour Verbier processes personal data of customers in strict compliance with the applicable data protection laws. Visits to our Bonjour Verbier online shop are recorded and we reserve the right to evaluate the data collected in the process. However, all data will be treated with absolute confidentiality and will be used to process orders, improve customer satisfaction, for further customer care and for statistical purposes. This also includes marketing measures, such as electronic newsletters. Customer data will only be made available to third parties to the extent necessary to process orders and payment transactions. Especially in the case of online orders, this also includes the transmission of payment data to the defined financial service providers.

Place of performance, place of jurisdiction and applicable law

The place of performance for our deliveries of goods as well as for your purchase price payments is our registered office in Bern. The present General Terms and Conditions and the contracts concluded on the basis of these General Terms and Conditions are subject to Swiss law. The acceptance of your order by Bonjour Verbier constitutes a contract of sale within the meaning of Art. 184 et seq. of the Swiss Code of Obligations. Unless these provisions state otherwise, the provisions of the Swiss Code of Obligations apply. Place of jurisdiction is 3000 Bern.

Final provisions

The General Terms and Conditions of Bonjour Verbier in effect at the time the contract is concluded shall apply to the contractual relationship. In particular, these shall also apply if they differ from those of the customer. Should individual provisions of these GTC be or become invalid, this shall  not affect the legal validity of the remaining provisions.
